Welcome to SurplusTrends.com. By using the Site, you hereby agree to be bound by the present Privacy Policy (the “Policy”) and are aware that the Policy may be modified or updated at any time, without prior notice and at Surplus Trends’ sole discretion. Any changes may be verified on the Site and is the responsibility of its users. Your use of the Site following the posting of any changes constitutes acceptance of those changes.
When purchases are made, you are also governed by various policies regarding shopping, shipping and returns. The terms “you”, “User” or “Client” are used to refer to anyone using the Site or making purchases.

WHAT DOES THIS POLICY COVER
The Policy covers the treatment of personally identifiable information, treatment of personal information and any other information gathered by Surplus Trends when you are using the Site. The Policy does not apply to the general practices and treatment of information by third parties not owned, controlled by Surplus Trends, including but not limited to any third party websites or services that you may choose to access through the Site of via a link from the Site or to any individuals that Surplus Trends does not manage or employ. We encourage you to carefully review the privacy policies of any third party website your access. We have named and provided links to the most important of these third party websites further in the Policy.
Finally, the Policy does not cover any personal information you may send via unsecured links such as emails, instant messenger or Twitter, as communications via these methods may be subject to interception, loss or alteration. We encourage any comments and suggestions but encourage anyone to carefully examine what personal information may be shared via these methods of communications.
Surplus Trends does not gather any of your personal information while you are using the Site. Personal information provided while signing up for an account or for a mailing list or while making a purchase, will be used solely for the stated purpose and with your informed consent.
Surplus Trends only uses the industry’s best practices (physical, electronic and procedural) in keeping data collected (including personal information) secured. In addition, Surplus Trends uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage and related technology required to run the Site. The aforementioned third parties have been selected for their high standards of security, such as Rackspace, its hosting partner and an industry leader in hosting websites.
Where purchases are made, all transaction data, including credit card information, is transferred by encrypted Secure Sockets Layer (SSL), the standard for Internet transactions.
LIMITED GATHERING OF INFORMATION FOR STATISTICAL, ANALYTICAL AND SECURITY PURPOSES
Surplus Trends uses Google Analytics to automatically collect certain information such as IP address’, browser and computer type, access times, web pages from which you accessed the Site and web pages you access from the Site. None of this information identifies you personally. This information is used in order to better understand the needs of our users and the needs of the Website in the aggregate. Surplus Trends also makes use of information gathered for statistical purposes to keep track of the number of visits to the Site for further improvements.
Surplus Trends reserves the right to use additional analytical or statistical programs or services in the future. Any personal information transferred to a third party in this manner, this section will be updated accordingly, though there may be a delay in the update. Your IP address and other relevant information may be used in order to trace any fraudulent or criminal activity, or any activity in violation of the Terms and Conditions.
NON-DISCLOSURE OF PERSONAL INFORMATION TO THIRD PARTIES
Personal information gathered via the Site will not be divulged to third parties unless your prior consent was obtained. In addition, Surplus Trends will not sell, rent, trade or license any personal information regarding its users to any third party. Only employees, representatives, subcontractors, officers, agents or assigns of Surplus Trends are responsible for the management and development of the Site and only these individuals have access to any information collected. The aforementioned employees, representatives, subcontractors, officers, agents or assigns have all been instructed to comply with the Policy.
Notwithstanding anything in the Policy to the contrary, Surplus Trends may share any information that has been collected about you or that you have submitted in the following ways:
1. In response to subpoenas, court orders, legal process or to establish, protect of exercise our legal rights or defend against legal claims or demands.
2. If Surplus Trends believes it to be necessary in order to investigate, prevent or take action in regards to illegal activities, fraud or situations involving potential threats to the safety of any person or any violation of the Terms and Conditions.
3. If Surplus Trends believes it to be necessary to investigate, prevent or take action regarding situations that involve abuse of the Site infrastructure or the Internet in general such as, but not limited to, voluminous spamming, denial of service attacks, attempts to compromise the security of the Site’s infrastructure or the Site generally
4. To a parent company, subsidiaries, joint ventures or other companies owned or operated by Surplus Trends. In any of those cases, the entities will be required to honor the Policy.
5. In the event that Surplus Trends is acquired by, or merged with, another entity. In any of those cases we will require that said entity to honor the Policy or inform you or a new policy being in effect.
Surplus Trends also uses certain third party services in order to augment the Site. Personal information may be transferred from Surplus Trends to these third party services, but only to the extent where required in order for them to function properly, and only upon your express submission of such information. The aforementioned third party services are limited to Facebook, Twitter, Tumblr, Pinterest and Google+ fro sharing of the Site’s content. If you are not already logged in those third party services, your personal information required to login to those accounts will be transferred securely from the Site to any of these third party services and is covered by their respective privacy policies which we also encourage you to read.
Surplus Trends uses MailChimp to manage its mailing list and sent out emails. Personal information is transferred to MailChimp in order to ensure the mailing list function properly and personal information is only used to send said emails. MailChimp does not use personal information for any other purpose than to send emails after you have signed up for Surplus Trends’ mailing list, nor will it transfer or sell personal information to third parties. For more information on MailChimp, we encourage you to refer to their Privacy Policy. You may unsubscribe from Surplus Trends’ mailing list at any time by following the link at the bottom of all Surplus Trends’ emails. A logged-in user may also unsubscribe from the mailing list by adjusting their mailing list preferences on their account page.
SECURED PAYMENTS
Surplus Trends provides two secured method of payments for purchases made on the Site. You may use your credit card directly on the Site in which case your personal information will be transferred to Moneris, a third party payment processor. Purchases may also be made using PayPal.
By making purchases on the Site, you authorize Surplus Trends to use these payment processors and to transfer submitted personal information to them in the extent necessary to complete the transaction. No credit card information is ever stored on servers controlled by Surplus Trends. PayPal has our permission to store, on behalf of Surplus Trends, the date pertaining to the executed transactions by clients of the Site with the goal of ensuring a secure method of payment and proof of purchase archive, allowing for the protection of Surplus Trends’ clients and for needed follow-ups. This transactional data may be used for validation and registration purposes of Surplus Trends’ clients and to trace any fraudulent activities if necessary. When a purchase is made using these payment processors, Surplus Trends’ clients are covered by the payment processor’s privacy policy. We encourage you to read Moneris and PayPal’s privacy policies to learn more about how your personal information is treated by those third parties.
Surplus Trends currently uses DoubleClick by Google to advertise on the Internet and by visiting or using the Site you consent to this use. More specifically, Surplus Trends uses the remarketing features that deliver you advertisements that will be of particular interest to you based on your browsing history at the Site. These advertisements will appear on third party websites around the web. Google uses specific cookies allow them to serve these ads around the web that will be of interest to you. This type of advertisement may be prevented, although not permanently, by deleting the appropriate Google cookie through your browser. For a more permanent solution we suggest you opt out of such Google advertising at any time by visiting your Google Ads Settings page.
ACCOUNTS AND DELETION OF PERSONAL INFORMATION
An account may be created by entering an email address and choosing a password. It is the client’s responsibility to create a password of sufficient length and complexity and to keep it secure in order to ensure the security of your personal information that can be accessed as a logged-in user. In order to make a purchase, an account must be made. Users must provide addresses for billing and shipping purposes. These addresses will be stored by Surplus Trends but will not be used for purposes other than billing and shipping on future purchases. Users may, at any time, delete these stored addresses on their account page.
Users who wish to cancel their account and have all personal information deleted from Surplus Trends’ records may do so by contacting us.
TRACKING TECHNOLOGY (COOKIES)
Surplus Trends uses tracking technology (“Cookies”) on the Site and by using the Site you agree to their use. Cookies are small date files stored on your computer’s hard drive when you visit the Site. These Cookies are used in order to enhance customer experience by storing certain information such as user ID or items viewed on the Site.
Your may refer to your browser’s help section to find out how it may be set to refuse Cookies or to deleted them after they have been stored. Take note that deleting Cookies may reduce your customer experience as you may be required to re-enter certain information when you use the Site or are trying to make a purchase such as your account login information. Surplus Trends is not responsible for any function that may not operate after Cookies have been deleted or for any damages, pecuniary or otherwise, arising from those functions not operating or having reduced functionality.
RISKS ASSOCIATED WITH THE INTERNET
Despite Surplus Trends’ best effort to ensure third parties will not access or obtain your personal information through the use of the Site, complete confidentiality and security cannot be guaranteed on the Internet. Communications via the Internet is subject to interception, loss or alteration. Users acknowledge and agree that Surplus Trends is not responsible for damages resulting from the transmission of confidential or personal information over the Internet and that such communications are at your own risks.
LIMITATION OF LIABILITY
Surplus Trends and / or any of its respective officers, directors, owners, officials, partners, partnerships, principals, employees, affiliates and other related entities, servants, agents, representatives, successors and assigns, will not be held liable for any damages resulting from the misuse of any information collected by any third party, or any misuse of any information collected through the Site in violation of the Policy.
COMPLIANCE WITH PRIVACY LAWS
This Policy and Surplus Trends’ practices in general are designed to be in compliance with Canada’s Personal Information Protection and Electronic Documents Act (“PIPEDA”, S.C. 2000, c.5).
